Q1. What is public
interest litigation (PIL)? Analyse some of the landmark judgements which enlarged
the scope of fundamental rights.
Public Interest Litigation (PIL) is a legal action initiated in a court of law for the enforcement of public interest or general interest in which the public or a class of the community has pecuniary interest or some interest by which their legal rights or liabilities are affected. It is a legal mechanism that enables individuals or groups to seek judicial redress when public interest is at stake. PIL is often used to address issues of social justice, environmental protection, corruption, and other matters affecting the general public.
Vishaka v.
State of Rajasthan (1997): This case addressed sexual harassment at workplaces
and led to the formulation of guidelines known as the Vishaka Guidelines, which
laid down preventive measures and procedures to deal with sexual harassment at
workplaces. The Supreme Court held that sexual harassment violates the
fundamental rights of Article 14, 19, and 21 of the Constitution, which
guarantee equality before the law, freedom of speech and expression, and the
right to life and personal liberty, respectively.
Bandhua Mukti
Morcha v. Union of India (1984): This case dealt with the issue of bonded labor
in brick kilns and stone quarries. The Supreme Court interpreted Article 21 of
the Constitution expansively to include the right to live with human dignity.
It ordered the release of bonded laborers and provided them with compensation
and rehabilitation measures.
MC Mehta v.
Union of India (1987): In this case, the Supreme Court addressed the problem of
pollution in the Ganga River. The court held that the right to a clean
environment is a fundamental right under Article 21 of the Constitution. It
ordered the closure of industries polluting the river and directed the
government to take measures to clean it up.
Nilabati Behera
v. State of Orissa (1993): This case involved the custodial death of a person
in police custody. The Supreme Court recognized the right to compensation for
victims of custodial violence under Article 21 of the Constitution. It held
that the state is vicariously liable to pay compensation to the victims or
their families for the violation of their fundamental rights.
Shriram Food
and Fertilizer Industries v. Union of India (2006): In this case, the Supreme
Court addressed the issue of hazardous wastes generated by industries. It held
that the right to a healthy environment is a fundamental right under Article 21
of the Constitution. The court directed industries to take measures to prevent
pollution and to compensate affected parties.
These landmark
judgments illustrate how PIL has been instrumental in enlarging the scope of
